Sex with woman on promise of marriage is rape: Supreme Court (India)

India's Supreme Court ruled that sex obtained through a false promise of marriage constitutes rape under the Indian Penal Code, a judgment with significant practical implications for how consent is understood in a society where marriage remains a dominant framework for romantic relationships.
The ruling addressed a common pattern in cases that come before Indian courts: a man and woman begin a relationship on the understanding that it will lead to marriage; sexual relations begin; the man later refuses to marry, citing family pressure, prior commitments, or changed circumstances; the woman files a rape complaint.
The court held that consent given on a false or fraudulent representation—including a promise to marry that the man had no intention of honoring—vitiates the consent for the purposes of the rape law. This is distinct from a genuine change of intention after the fact.
Legal scholars and women's rights advocates welcomed the ruling while noting the interpretive challenges it creates. Distinguishing between a promise made in bad faith and one made sincerely that was later broken requires courts to assess states of mind at the time of the promise—notoriously difficult evidentiary territory.
The judgment also reflects social realities specific to India. In a context where women's sexual choices are heavily constrained by family and social expectations, and where the only culturally sanctioned framework for sexual relations is marriage, the promise of marriage carries a particular coercive weight. A woman who would not otherwise have consented might do so on the basis of that promise.
Critics argued the ruling could be misused and that it placed courts in the difficult position of adjudicating romantic disappointments as criminal matters.
